1. Acceptance of Terms
By using the FreshFooda website, mobile app, or services, you agree to these Terms & Conditions. If you do not agree, please do not use our services.
2. Eligibility
You must be at least 18 years of age to create an account and place orders. By using our services, you represent that you meet this requirement.
3. Orders & Payment
- Orders are confirmed only after successful payment processing.
- All prices are in USD and include applicable taxes. Delivery fees are shown at checkout.
- We accept major credit/debit cards through Stripe. By submitting your card, you authorize us to charge the total amount shown at checkout.
- We reserve the right to cancel orders if a menu item becomes unavailable after order placement. A full refund will be issued.
4. Delivery
- Delivery is available only within our serviceable ZIP codes. You can verify your ZIP at checkout.
- Estimated delivery times are provided as a guide. FreshFooda is not liable for delays caused by traffic, weather, or circumstances beyond our control.
- You are responsible for ensuring someone is available at the delivery address. FreshFooda is not responsible for food left unattended after delivery.
5. Cancellations & Refunds
- Single orders can be cancelled without charge if cancelled at least 2 hours before the scheduled delivery window.
- Cancellations after this window may be subject to a partial charge to cover preparation costs.
- Refunds for unsatisfactory meals are evaluated case by case. Contact us within 24 hours of delivery with photos of the issue.
- Refunds are credited back to the original payment method within 5–7 business days.
6. Subscriptions
- Meal plan subscriptions renew automatically on a weekly basis unless paused or cancelled.
- You may pause or cancel your subscription at any time from your account dashboard. Changes take effect at the start of the next billing cycle.
- FreshFooda reserves the right to modify subscription pricing with 14 days notice to active subscribers.
7. Food Safety & Allergens
While we strive to accommodate dietary restrictions, our kitchen handles common allergens including gluten, dairy, nuts, eggs, and soy. We cannot guarantee allergen-free preparation. If you have severe food allergies, please contact us before ordering.
8. Promo Codes
Promotional codes are subject to their own terms including expiry dates, minimum order values, and maximum usage limits. Codes cannot be combined unless explicitly stated. FreshFooda reserves the right to revoke promotional offers at any time.
9. Intellectual Property
All content on FreshFooda — including logos, images, recipes, and text — is the property of FreshFooda and may not be reproduced without prior written consent.
10. Limitation of Liability
FreshFooda's liability is limited to the value of the order in question. We are not liable for indirect, incidental, or consequential damages. Our services are provided "as is" without warranties of any kind beyond those required by law.
11. Governing Law
These Terms are governed by the laws of the State of Illinois. Any disputes will be resolved in the courts of DuPage County, Illinois.
